Copyright Registration

Copyright is a legal concept, enacted by most governments, giving the creator of an original work exclusive rights to it, usually for a limited time. Generally, it is 
"the right to copy", but also gives the copyright holder the right to be credited for the work, to determine who may adapt the work to other forms, who may perform the work, who may financially benefit from it, and other related rights. It is an intellectual property form (like the patent, the trademark, and the trade secret)  applicable to any expressible form of an idea or information that is substantive and discrete.

Types of Copyright

Importance and Advantages of Copyright

Copyright is a major part of Intellectual property where one can claim exclusive rights over the created identity which may be in any above mentioned form.
Several exclusive rights typically attach to the holder of a copyright:
●    to produce copies or reproductions of the work and to sell those copies (including, typically, electronic copies/online)
●    to import or export the work
●    to create derivative works (works that adapt the original work)
●    to perform or display the work publicly
●    to sell or assign these rights to others
●    to advertise or display by radio/video/online

Copyright Registration acts as a strong legal tool to ovoid the infringe-ment and fraudal use of the Copyrighted work.


   Manufacturing Industry (TM-60)

Procedure for registration of a logo / monogram (Other than that of service Industries :
a)    To apply for search to ascertain whether any logo are on record which is similar to the artistic work (Logo)
b)    Preparation of Power of Attorney on the required stamp paper.
c)    Applying for Copyright Registration, if the search is cleared.
d)    Attending to the proceedings and obtaining Provisional Papers after necessary follow up. This procedure takes about 15-20 days. After this stage you can write © besides your brand names / artistic work.
e)    Official objections / opposition, if any.
f)    Receiving Registration Certificate after 10 months.

Service Industry (Form IV)    

Procedure for registration of Software / Home page / Web Content
/ Book / any Literary Material / logo / monogram for service Industries:
a)    Preparation of Application fax Copyright Registration and submission of the same along with copies of software / book.
b)    Attending to the proceedings and obtaining Provisional Papers after necessary follow up.
The above procedure takes about 15-20 days time. After this stage you can write © and “All rights reserved” on your software / book.
c)    Receiving Registration Certificate after 10 months.
